1. Agreement to Terms

These Terms of Service govern your use of the website melalinusapenida.com and the booking of services offered by CV Melali Nusa Penida, a tour operator registered in Nusa Penida, Bali, Indonesia.

By making a booking or using our website, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree, please do not use our services.

2. Services

CV Melali Nusa Penida offers the following services:

• Private and sharing day tours in Nusa Penida.
• Fast boat transfers between Sanur, Kusambe, Nusa Penida, and Nusa Lembongan.
• Snorkelling and activity packages.

All services are subject to availability. We reserve the right to modify or discontinue any service at any time without prior notice.

3. Booking Policy

• Bookings are confirmed only upon receipt of full or agreed partial payment and written confirmation from us via WhatsApp or email.
• Prices are quoted in Indonesian Rupiah (IDR) or USD as displayed. Exchange rate fluctuations are the responsibility of the customer.
• It is your responsibility to provide accurate passenger details (names, contact information, travel dates) at the time of booking.
• Hotel pick-up is available within the agreed service area. Locations outside this area may incur an additional fee.
• Bookings for boat tickets require a valid identity document (passport or national ID) for each passenger.

4. Cancellation Policy

To cancel a booking, please contact us via WhatsApp with your booking reference. Refunds will be processed within 7–14 business days to the original payment method.

5. Refund Policy

• If we cancel a tour due to weather conditions, safety concerns, or circumstances beyond our control (force majeure), you will receive a full refund or a complimentary reschedule at no extra cost.
• Boat ticket refunds are subject to the cancellation policy of the respective boat operator. We will assist you in processing the refund request.
• Refunds are not provided for unused portions of a tour (e.g., if you choose to skip an activity during the trip).
• Bank transfer fees or payment processing charges are non-refundable.

6. Rescheduling

We allow free rescheduling if requested at least 48 hours before your departure date, subject to availability. Rescheduling requests made within 48 hours may be subject to an administration fee. Contact us via WhatsApp to arrange a new date.

7. Health, Safety & Conduct

• Participation in tours and water activities involves inherent risks. You participate at your own risk.
• You must disclose any medical conditions, disabilities, or allergies that may affect your participation prior to booking.
• Children under 5 years and guests over 70 years of age may be restricted from certain activities for safety reasons.
• Guests are expected to behave respectfully towards guides, staff, local communities, and the natural environment. We reserve the right to exclude any guest whose behaviour endangers others or violates local customs.
• Life jackets must be worn during all boat transfers and water activities as directed by crew.

8. Limitation of Liability

CV Melali Nusa Penida shall not be liable for:

• Loss, theft, or damage to personal belongings during tours or transfers.
• Injury, illness, death, or loss arising from participation in tours or water activities beyond our reasonable control.
• Delays or cancellations caused by weather, sea conditions, government restrictions, or other force majeure events.
• Actions or omissions of third-party service providers (e.g., hotels, restaurants, boat companies).

Our total liability for any claim shall not exceed the amount paid by you for the affected service. We strongly recommend purchasing comprehensive travel insurance before your trip.

9. Intellectual Property

All content on this website — including text, photographs, videos, logos, and graphics — is the property of CV Melali Nusa Penida or its licensors and is protected by applicable copyright laws. You may not reproduce or distribute any content without our prior written consent.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Klungkung Regency, Bali.

11. Changes to These Terms

We reserve the right to update these Terms at any time. The date at the top of this page indicates the last revision. Continued use of our services after changes constitutes acceptance of the updated Terms.
